3. Returns, Exchanges, and Refund Policy
• Statutory Right of Return
In accordance with Kuwaiti Law No. 39/2014 (Consumer Protection Law),
customers are entitled to exchange or return non-defective products
within fourteen (14) days of the purchase date, provided that the product is in
its original, unused, and "as-purchased" condition, and is accompanied by the
original sales invoice.
• Hygiene and Public Health Exceptions
Under the Executive Regulations of Law No. 39/2014, certain goods are strictly
excluded from the "change of mind" return policy for reasons of public health and
personal hygiene. Because hearing aids, M&RIE receivers, SureFit receivers,
slim tubes, and ear domes are medical devices that come into direct contact with
the ear canal and bodily fluids (earwax/skin oils), they are classified as Hygiene
Sensitive Medical Equipment.
• Sealed Products: May be returned within 14 days if the manufacturer's security
seal is completely intact.
• Opened or Used Products: Once the security seal is broken or the device has
been placed in the ear, the product is considered "used." For the protection of all
our patients, these items cannot be returned or exchanged as they cannot be
legally resold to another consumer. This is consistent with the legal treatment of
other personal hygiene items (such as undergarments) under Kuwaiti commercial
standards.
• Proven Manufacturing Defects
Pursuant to Article 12 of Law No. 39/2014, if a product is found to have a
manufacturing defect, the consumer has the right to have the item repaired,
replaced, or refundef
• All claims of defects must be verified by our authorized technical department.
• Damage caused by improper maintenance (e.g., earwax blockage, moisture
damage, or unauthorized repair) does not qualify as a manufacturing defect and is
not eligible for return or refund.
• Professional Consultation
Hearing aids are medical devices that require professional fitting. Our "No
Return" policy on used equipment ensures that every customer receives a brand
new, sterile, and factory-sealed device. We encourage all clients to complete their
trial and consultation before breaking the product sealed (lawskw.com)
4. Medical Services
Medical consultations, procedures, and treatments are provided in accordance with
applicable laws and MOH regulations. Refunds for services are only applicable if
required by Kuwaiti law.
5. Patient Data & Privacy
Patient information is handled according to Kuwaiti data protection standards and
MOH guidelines. Personal medical records are kept confidential and used only for the
purpose of providing healthcare services. Disclosure to third parties requires patient
consent unless legally mandated.
6. Payment Terms
Payments for medical services and products must be made according to the clinic’s
pricing and payment policies. Invoices must be issued as required by Kuwaiti law.
7. Force Majeure / Unexpected Events
The clinic is not liable for delays or failure to provide products or services due to events
beyond its reasonable control, including but not limited to natural disasters, government
restrictions, or other unforeseen circumstances.
8. Liability
The clinic is liable only in accordance with Kuwaiti law for any direct damages caused
by defective products or improper services. The clinic is not liable for indirect or
incidental damages beyond what is stipulated by law.
9. Governing Law
All terms and policies are governed by and interpreted according to the laws of the State
of Kuwait, including Consumer Protection Law No. 39 of 2014.
